You are staring at a soaked sofa and a manager who says “file it with your insurance.” They might be half right. They might also be ducking the part that is actually their job.

In Texas, landlords generally have to repair conditions that materially affect health or safety once you give notice and you are current on rent. Flooded floors, sewage, and a dead electrical system sit in that bucket. Your TV does not.

  1. Find the lease PDF or paper copy. Photograph the repair, casualty, and insurance pages.
  2. Send written notice of the water and any health or safety problem. Date it.
  3. Open a renters claim for your belongings if you have a policy. Get a claim number.
  4. Ask the landlord, in writing, who is extracting water and when the unit will be habitable.

What owners usually own

Structure, roof, plumbing stacks, HVAC that serves the unit, and making the place safe to occupy again. That is the usual split in Houston garden apartments and townhomes. If street water came through the slab or a bayou came in the door, they still have to deal with the building. They do not have to replace your mattress. They also do not get to leave you in black-water carpet while they “wait on corporate.”

What you usually own

Clothes, furniture, food, and the stuff in the closet. Renters insurance, if you bought it, is the path for that. Many Houston leases require a policy. If you skipped it, you are looking at savings, family, 211, and maybe FEMA Individual Assistance if a declaration covers Harris County. The landlord’s building policy is not a secret stash for your sneakers.

The gray zone people fight about

Who pays for a hotel. Whether rent is due while the unit is gutted. Who owns window AC units and stacked washer hookups. Do not guess from a Facebook group. Ask for the answer in writing and keep paying what you owe unless a lawyer, a court, or a clear casualty clause says otherwise.
